In one of the agreements,plastering item of 15mm thickness was executed and measurements for 12mm were recorded in the Measurement book.payments were made for 12mm plastering item as the agreement includes only 12mm.subsequently plastering item 15mm included in subsidiary agreement and got sanction.Now while making payment for 15mm plastering item,12mm plastering which was earlier operated is shown as minus item in the bill. Is it permissible ? if Yes..how it is to be done.when the work is done for higher dimension and payment is made for lower dimension due to the presenece of an item in agreement..what is the procedure.please elucidate....

What they have done is introduced a new item. Was introduction of the new item concurred in by you and if so was the rate thereof found to be justified. This
would also require approval of CA for -100% variation for 12mm and a certificate that this item would not be required in the same work again. Moreover if 15mm
is a non schedule item , it would also need to be supported by a rate analysis. I am sure you would have already dealt with the case by now on some similar
advice. If not do so in future and also ask the Civil guys whether Railway's interest was protected adequately ( in case subsidiary agreement was signed
already without seeking prior finance concurrence ). The Measurement book chap should also be suitably counselled/ hauled up with some sense of proportion as
tomorrow he may record 15mm for a work of 12mm.

Ramanujam - Your example only exemplifies the aphorism. The issue here is make any rule, the contractor out there is smarter. The fact is that contractor did
15mm plaster. He would have done only on the orders of engineer-in-charge. So, why should he be penalised / harassed / made to run from pillar to post when it
comes to billing? If he is straight and narrow, he will never make money. Working Capital is the juice that makes his returns. Doesn't matter if he gets
10K (for 12mm) instead of 12k (for 15mm) rather than get nothing! Peluji, MB guy knows that nothing will happen if he under-records as you cannot make a case
of overspend. The point here is simple, variation in contracts should be managed properly, some variations should just be allowed at the certificate of
engineer in charge as long as the overall scheme of things does not change.

I agree Buddha' s pride that engineer in - charge calls the shots at site. variations however are subject to manipulations and thats what has happened in
this case by recording the scheduled item in MB so that the bill does not get held up for want of concurrence and the actual item executed is paid for later by
introducing an non schedule item . this way all are happy and a mockery is made of the contract. Ramnujam ends up paying as per actuals but the engineer in
charge goes scot free.
