Posts: 381 (10/30/06 06:03:30) Reply Quote More My Recent Posts Message Me Connection Blocking Invite Ignore User's Posts	Tags : None Respected All, On 26.10.2006 DGM( G) office / ER issued letter regarding Revision of constitution of tender committee according to which 1. For tender valuing Rs. 1 Crores to Rs. 2 Crores, all the members will be of JA Grade and it will be accepted by Selection Grade member. 2. For tender valuing Rs. 2 Crores to Rs. 6 Crores, all the members will be of J.A. Grade / Selection Grade . Thus for tenders for Rs. 1 cr. to Rs. 2 Cr., Sr.DFM will be member along with JA Grade members and it will be accepted by Sr.DEN/Co. if he is in selection Grade but same Sr.Den/Co. will be member along with Sr.DFM for tender valuing from RS. 2 Cr. to Rs. 6 Cr. Is this proper ? Is there any guideline on the subject from Rly. Board. With regards KKGOYAL Sr.DFM/HWH

However many smaller TCs esp. of GM bungalow, MR's visit etc. were done by Sr DEN as a member and accepted by ADRM. I do not see why it should be a problem. In bureaucracy things are usually viewed from a person-neutral, chair-specific view.

Posts: 381 (10/30/06 21:48:45) Reply Quote More My Recent Posts Message Me Connection Blocking Invite Ignore User's Posts	Dear All, As such there is no problem in this delegation but what I have seen in last 10 years that generally there is no seperate delegation for JA Grade and Selection Grade and tenders of a JA grade committee are not accepted by a Selection Grade member and thats why Selection Grade is called Non-Functional Selection Grade. is there such delegartion in any Other Railway ? I am not aware . KKGOYAL

Hence differentiation of powers on the basis of JAG and SG might not be proper.Between JAG and SAG-yes. Moot point, as asked by Ram Manohar, is whether the notification has been issued by Competent Authority (!!) after observing due procedures.My guess is that proper procedures have not been followed as such power demarcation and differentiation is not available between JAG and SG. As for Freefall's point "In bureaucracy things are usually viewed from a person-neutral, chair-specific view."- this begs the question put forth by Goyalsir. Yes, it is chair specific and chair is on an indifference curve in so far as it relates to JAG and SG. Chair is Sr.DFM and Sr. DEN. Chair is not Sr.DFM(JAG) and Sr.DEN(SG). I hope I have been able to put forth my point for whatever it is worth. scmitra

GMs have powers to make their own SOPs as per Negative Delegation of Powers.In most of the SOPs, one will come across certain powers which are to be personally enjoyed by DRMs (viz. creation of supernumerary posts in divisions) even though ADRM is also of the same rank. Some differentiation is also there between them even though they are both SAG.Hence, if GM has approved the current arrangement of incorporating this differentiation in SOP after FA's concurrence, it is valid and good in the eyes of law. Should be followed,atbest after one reference! scm

Bd's letter no. 2004/CE-I/CT/13 Dated 24/08/2004 state that ( www.irastimes.org/SRly_Co...ENDER.htm) Sub: Improper use of Schedule of Powers (SOP) in finalization of tender. In all tender cases, recommendation of Tender Committee (T.C.) should be put up to next higher authority for acceptance. The practice of putting up the T.C.s recommendations to a colleagues in the same grade/Level is in gross violation to the instructions issued vide Boards letter referred to above and Vigilance Directorate has taken a serious view of such irregularity. It is therefore reiterated that the instructions issued in above mentioned letter may strictly be followed. Receipt of this letter may please be acknowledged. PARMOD KUMAR Exec Director, Civil Engg. Posts: 126 (11/02/06 01:08:33) Reply Quote More My Recent Posts Message Me Connection Blocking Invite Ignore User's Posts	A similar case was once posed to me by a Sr DFM who did not have a DFM under him: He had to take part in TC's of DFM level as there was no Sr Scale Finance officer. These TC's were held, say, with DENs and accepted by Sr. DEN. He was of the opinion that ( quoting the Rly Bd letter mentioned by Goyal above) which prohibits the acceptance of TC's recommendations by an officer of the same grade/level ) since a JAG officer (Sr DFM) was part of the TC, the acceptance should be of DRM/ADRM. The DRM/ADRM was of the opinion that the rank of the convenor decides the issue wrt this letter and not the finance member and just because the FA & CAO is not posting a Sr Scale officer, he would not do the work of others and accept TC's which were within the powers of JAG for acceptance. I thought DRM/ADRM was right. Any opinions? Also, from which year did AEN's start taking part in TC's ? Kartic Chauhan

But the problem brought out by Kartic sir over here is with the executives. For example, sectional Sr.DENs sit for TCs both with DFM and Sr.DFM. And since there is no DEE (G), Sr.DEE (G) does his TCs with my ADFM. But in both the cases, the tenders are accepted by ADRM and thankfully, he doesn't complain about doing the work of JAG officers. I am of the opinion that since ADRMs/DRMs do not have a say in the posting of the officers working under their charge, they should put up with the officers posted by the respective PHODs. Of course, they can formally or informally put up their resquests for change of officers or posting of additional officer(s) in the division. But they cannot deviate from the tender guidelines issued by Board on the pretext that they do not want to do the work assigned to a JAG officer. And sir, AENs have been doing TCs since a long time. They sit for the 2-member TCs, the limit for which is Rs.20 lakh in SECR (earlier it was Rs.10 lakh). These tenders can be accepted by a Senior scale officer. R.Ananth Sr.DFM/BSP

Posts: 126 (11/02/06 03:25:49) Reply Quote More My Recent Posts Message Me Connection Blocking Invite Ignore User's Posts	Normally, Sr DEN (Co) of a division only has a AEN HQ under him so most of the TC's, of his charge,have to be done by the Sr DEN (Co) himself. These may be with the ADFM, DFM or the Sr DFM, and since he is himself acting as convenor, the TC is accepted by ADRM/DRM. So far so good. But my poser was, what if there is no DFM and Sr DFM takes part in TC's as the finance member and where acceptance is of Sr DEN (Co)'s level? Will the provisions of the Rly Bd's letter under question apply here, since one of the members of the committee ( Sr DFM) will be equivalent to the AA (Sr DEN (Co) ? Regarding AEN's taking part in TC's I know that they do. By asking for the year in which they were allowed, I was trying to place the seniority of freefall! Kartic Chauhan

When it comes to 2-member TCs, the ADFM sits with the sectional AEN or AEN/HQ (as the case may be) and the sectional DEN/Sr.DEN accepts the tender. Once it goes above Rs.20 lakhs, the same DEN/Sr.DEN becomes the member of the TC with the ADFM and the tender is accepted by Sr.DEN (Co) or ADRM. But the ED (CE)'s letter is clear and it can be interpreted to mean that the AA has to be one level higher than the highest ranking member of the TC. R.Ananth Sr.DFM/BSP

How DRM/ADRM can say that he will not do somebody else's job ? is this work personal ? DRM/ ADRM can't interpret rule in his own way ? I also worked in three Railways and this kind of situation never arises ? When I was BSB / NER Diovision , there was no DFM post and if there is any tender of sectional DEN of senior scale delegation , but because there was no DFM and ADFM can't be a Finance member , the tender committee convenor was Sr.DEN/CO and SR.DFM as Finance Member and ADRM as Accepting Authority. Railway Bd's another Circular no. 88/CE-I /CT/76 dated 23.12.1988 state that " In supression of all Instructions, Board have now decided that Consquent to posting of ADRM's on all Divisions in all such cases tender committee should be put up to next higher authority for acceptance and practice of putting TC recommendation to Colleauge should be dis-continued with iommediate effect." even Vigilance directorate has raise objection to this situation . Dy.CAO (G), by virtue of being the indentor, was the third member of the Stores TC while Sr.AFA (FS) was the finance member in Senior scale and Dy.CMM (G) was the member from Stores. A JAG and a SS finance officer in the same TC! I wonder what would have been the composition if it was for the procurement of furniture for the Stores Accounts office! But I think Dy.CAO (G) is the indentor for the entire HQ Accounts office, if I am not wrong. R.Ananth Sr.DFM/BSP

Posts: 652 (11/06/06 00:54:22) Reply Quote More My Recent Posts Message Me Connection Blocking Invite Ignore User's Posts	Since the accepting authority has to take a view taking into account the unanimous or dissenting views of TC members and Senior Officers are expected to have a more mature opinion , it is but logical to presume that the accepting Authrity should be one rank above the TC members. For typical situations where a DFM or a DEN may not be posted aberrations can exist with the approval of GM and concurrence of FA&CAO. The Eastern Railway's letter therfore seems to be violating Board's instructions and could perhaps br reviewed. Ranjanesh
